These Terms of Service (the “Terms”) govern your use of battlebornprints.com and any related services provided by Battle Born Prints (“Battle Born Prints,” “we,” “us,” or “our”). By visiting our website, purchasing a product, submitting a custom design, or otherwise using our services, you agree to these Terms. If you do not agree, do not use the website or place an order.

Our store is hosted by Shopify Inc., which provides the e-commerce platform that allows us to sell products and services to you. Certain products are produced and fulfilled by independent print-on-demand partners, including Printify and its print providers.

1. Eligibility and lawful use

You must be at least the age of majority in your state or province of residence, or have permission from a parent or legal guardian, to use this website or place an order. You may not use our products, website, or services for any unlawful, fraudulent, abusive, or unauthorized purpose. You may not introduce malware, attempt to interfere with the website, scrape or copy the website through automated means, or violate any applicable law or third-party right.

We may refuse service, cancel an order, restrict access, or remove content when reasonably necessary to protect Battle Born Prints, our customers, our service providers, or third parties, or when we believe these Terms or applicable law have been violated.

2. Products and print-on-demand fulfillment

Many Battle Born Prints products are made to order. After an order is submitted, it may be automatically sent to a third-party print provider for production. Production may begin quickly, and an order may no longer be changed or canceled once it has entered production.

Product colors, print placement, sizing, and appearance may vary slightly from photographs or digital mockups due to screen settings, garment manufacturing, print method, and normal production tolerances. Such minor variations are not defects. Product descriptions, images, availability, pricing, and specifications may be corrected or changed without notice.

We may use different print providers based on product availability, destination, quality, or production capacity. If an item becomes unavailable, we may contact you about an alternative, delay, or cancellation and refund.

3. Orders and acceptance

Your order is an offer to purchase. An order confirmation acknowledges receipt but does not guarantee acceptance. We may reject or cancel an order for reasons including suspected fraud, payment failure, pricing or listing errors, prohibited content, unavailable products, inaccurate shipping information, or purchase limits.

You agree to provide accurate, complete, and current billing, payment, contact, and shipping information. Please review product selections, sizes, colors, personalization, spelling, and delivery details before submitting an order.

4. Pricing, payment, taxes, and promotions

Prices are shown in U.S. dollars unless otherwise stated. Shipping charges and applicable taxes are calculated and displayed during checkout. You authorize us and our payment processors to charge the payment method you provide for the total amount shown at checkout.

We may correct pricing or typographical errors and may cancel an affected order. If payment has already been collected for a canceled order, the amount charged will be refunded to the original payment method. Discounts and promotional codes are subject to their stated conditions, cannot be redeemed for cash, and may not be combined unless expressly allowed.

5. Production, shipping, and delivery

Production and delivery estimates are estimates, not guarantees. Production time is separate from shipping time. Delays may occur because of carrier disruptions, peak demand, weather, supply shortages, customs, incorrect addresses, or events outside our reasonable control.

An order may arrive in multiple packages when products are fulfilled by different providers. Risk of loss passes as permitted by applicable law when the order is delivered to the address supplied at checkout.

You are responsible for providing a complete and accurate delivery address. If a package is returned, lost, or undeliverable because of an incorrect or incomplete address supplied by you, you may be responsible for reprinting and reshipping costs. If tracking shows delivery but you cannot locate the package, contact the carrier and Battle Born Prints promptly. International customers are responsible for customs duties, import taxes, brokerage charges, and local fees unless checkout expressly states otherwise.

6. Cancellations and order changes

Contact us immediately if you need to change or cancel an order. We will try to help, but we cannot guarantee changes or cancellations. Once an order has entered production, it generally cannot be changed or canceled because it is being manufactured specifically for you.

7. Returns, refunds, replacements, and order issues

Because most products are made to order, we generally do not accept returns or exchanges for buyer’s remorse, incorrect size or color selection, change of mind, or an address entered incorrectly by the customer. Review the product description and size guide before ordering.

If an item arrives damaged, defective, misprinted, or materially different from the item ordered, contact us within 30 days after delivery at battlebornprintsinc@gmail.com. For packages lost in transit, contact us within 30 days after the estimated delivery date. Include your order number, a description of the issue, and clear photographs of the product, packaging, shipping label, and defect when applicable. Keep the item and packaging until the claim is resolved.

After reviewing the claim, we may offer a replacement, reprint, store credit, or refund, as appropriate. We may deny claims submitted outside the stated period, claims without sufficient evidence, normal print or color variation, damage caused by misuse or improper care, or issues caused by customer-provided information. Refunds approved by us are normally returned to the original payment method; bank processing times may vary.

Nothing in these Terms limits any non-waivable rights or remedies available under applicable consumer-protection law. Additional details appear in our Return and Refund Policy, which is incorporated into these Terms by reference.

8. Custom and personalized products

You are responsible for reviewing and approving all names, dates, spelling, colors, sizes, placement instructions, and other customization details. We are not responsible for errors contained in customer-approved artwork or information submitted by the customer.

We may reject any customization request or design that we reasonably believe is illegal, infringing, deceptive, defamatory, threatening, hateful, obscene, exploitative, unsafe, or otherwise prohibited by our fulfillment partners. We may also reject content containing sensitive personal information or content that promotes terrorism, child exploitation, self-harm, or violence against protected groups.

9. Customer-submitted content and intellectual property

You retain ownership of content you submit, subject to any rights held by others. By uploading or providing artwork, photographs, logos, text, names, or other material (“Customer Content”), you represent and warrant that:

• you own the Customer Content or have all permissions, licenses, consents, and releases needed to use and reproduce it;

• the Customer Content does not infringe any copyright, trademark, patent, publicity, privacy, or other right;

• the Customer Content and the requested product comply with applicable law and these Terms; and

• any person depicted has authorized the requested use where consent is legally required.

You grant Battle Born Prints, Shopify, Printify, participating print providers, carriers, and necessary service providers a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, modify for production, print, package, and distribute Customer Content solely as necessary to review, manufacture, fulfill, deliver, support, and document your order.

You agree to indemnify Battle Born Prints against third-party claims and reasonable losses arising from Customer Content you submit or your breach of this section. We may request proof of authorization and may refuse, suspend, or cancel a custom order if satisfactory proof is not provided.

Unless otherwise stated, the website and Battle Born Prints-created text, graphics, artwork, logos, photographs, product designs, and branding are owned by or licensed to Battle Born Prints and may not be copied, reproduced, distributed, sold, or used commercially without prior written permission.

10. Reviews, feedback, and communications

If you submit a review, suggestion, photograph, or other non-private feedback, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, edit, publish, and display it for operating and promoting Battle Born Prints, subject to applicable law and our Privacy Policy. You represent that your submission is truthful, based on your genuine experience, and does not violate another person’s rights.

You agree that we may send transactional communications about orders, payments, shipping, returns, security, and policy updates. Marketing communications will be sent in accordance with your choices and applicable law.

11. Third-party services and links

The website may rely on or link to third-party services, including Shopify, Printify, print providers, payment processors, shipping carriers, analytics services, and social media platforms. Those services may be governed by separate terms and privacy policies. We are not responsible for third-party websites or services except to the extent required by law.

12. Privacy

Our collection and use of personal information are described in our Privacy Policy. By using the website, you acknowledge that order and contact information may be shared with Shopify, Printify, print providers, payment processors, carriers, and other vendors as reasonably necessary to process payments, produce products, deliver orders, prevent fraud, provide customer support, and comply with law.

13. Disclaimer of warranties

To the fullest extent permitted by law, the website, services, and products are provided “as is” and “as available.” Battle Born Prints disclaims implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, except where such warranties cannot lawfully be excluded. We do not warrant that the website will be uninterrupted, error-free, or completely secure.

This section does not affect express product promises we make in writing or rights that cannot be waived under applicable law.

14. Limitation of liability

To the fullest extent permitted by law, Battle Born Prints and its owners, employees, agents, contractors, suppliers, and service providers will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages, including lost profits, lost data, or business interruption, arising from the website, products, services, or these Terms.

To the fullest extent permitted by law, our total liability for any claim will not exceed the amount you paid Battle Born Prints for the product or order giving rise to the claim. These limitations do not apply where prohibited by law or to liability that cannot legally be limited.

15. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Battle Born Prints and its owners, employees, agents, contractors, affiliates, suppliers, and service providers from claims, damages, liabilities, costs, and reasonable attorneys’ fees arising from your unlawful use of the website, your violation of these Terms, your Customer Content, or your infringement of another person’s rights.

16. Governing law and disputes

These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles. Unless applicable law requires otherwise, any legal action relating to these Terms or a purchase from Battle Born Prints must be brought in a court of competent jurisdiction located in Mohave County, Arizona, and you consent to that jurisdiction and venue.

Before filing a claim, you and Battle Born Prints agree to make a good-faith effort to resolve the dispute informally by written notice describing the issue and requested resolution. Nothing in this section prevents either party from seeking relief in small claims court when eligible or limits any non-waivable consumer right.

17. Changes to these Terms

We may update these Terms to reflect changes in our services, fulfillment partners, business practices, or legal obligations. The revised version will be posted on this page with a new “Last updated” date. Changes apply prospectively unless otherwise required by law. Your continued use of the website after an update constitutes acceptance of the revised Terms.

18. Severability, waiver, and entire agreement

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. These Terms, together with our Privacy Policy, Return and Refund Policy, Shipping Policy, and any policies or notices posted on the website, form the agreement between you and Battle Born Prints concerning the website and your purchases.
